Court Dismisses Rahul Gandhi’s Petition Challenging Savarkar Remarks Summon
Lucknow (The Uttam Hindu): Congress leader and Leader of Opposition in the Lok Sabha, Rahul Gandhi, has received a setback from the Lucknow bench of the Allahabad High Court in the alleged objectionable remarks case regarding freedom fighter Vinayak Damodar Savarkar. The court has dismissed his petition. Justice Subhash Vidyarthi's single bench clarified that Rahul Gandhi has the option of filing a revision petition in the sessions court, so there is no need for the High Court to intervene.
Congress leader Rahul Gandhi’s troubles increased as the High Court dismissed his petition in the Savarkar comment case**: Rahul Gandhi had challenged the lower court's order in which he was summoned in the case related to his remarks on Savarkar. He had also demanded that the ongoing proceedings against him be quashed. His lawyer, Pranshu Agarwal, argued that based on the charges, no case could be filed under Sections 153A and 505 of the Indian Penal Code, yet the lower court had issued summons under these sections. He also pointed out that the court had bypassed the provisions of Section 196 of the Code of Criminal Procedure. However, the High Court dismissed the petition without commenting on the merits of the case.
