US Visa Crackdown: 1 Lakh Indians May Be Forced to Return to India Amid New Policies

New Delhi (The Uttam Hindu): A recent change in US visa policies has left over 1 lakh Indian children in the United States facing an uncertain future. These children, born to Indian H1-B visa holders, are at risk of being sent back to India due to the expiration of their dependent visas when they turn 21. According to data from March 2023, approximately 1.34 lakh Indian children are expected to lose their dependent visa status before their families receive green cards. This has created a sense of panic among Indian families in the US, with many worried about the future of their children. The US immigration policy previously allowed children of H1-B visa holders to choose a new visa status within two years of turning 21. However, changes in the rules under the Trump administration and recent court cases have increased the possibility of this provision being terminated. The uncertainty surrounding the new visa rules has left many Indian youth in the US feeling trapped. Without the provision of dependent visas, they may be forced to return to India, disrupting their education and career plans.
There are several types of US visas available for Indians, including:
- B-1/B-2 Visitor Visa: For tourism or business purposes
- C-1 Transit Visa: For transit through the US
- D Crew Member Visa: For crew members serving on a ship or aircraft
- H-1B Work Visa: For specialty occupations requiring theoretical or technical expertise
- L1 Intracompany Transfer Visa: For intracompany transfers working in managerial, executive, or specialized knowledge roles
- J1 Exchange Visitor Visa: For participants in exchange programs that promote cultural exchange
New US Visa Rules for 2025: The US Embassy in India has announced new visa appointment rules for 2025, aimed at reducing wait times and ensuring equitable access to visa interviews. The new rules include a one-time free reschedule option, with subsequent reschedules requiring a new appointment and fee.
