Delhi Police Under Fire: Court Questions FIR Refusal Against X, Netflix

New Delhi (The Uttam Hindu): A Delhi court on Thursday directed the Delhi Police to respond to its refusal to file an FIR (First Information Report) against X (formerly Twitter) and Netflix over allegations of distributing pornographic and obscene content. The case, filed by former Information Commissioner Uday Mahurkar through Advocate Vineet Jindal, argues that both platforms are making pornographic material accessible without restrictions, which is impacting young audiences.
The complaint highlights violations of several laws, including the Bharatiya Nyaya Sanhita (BNS), Protection of Children from Sexual Offences (POCSO) Act, Information Technology (IT) Act and the Indecent Representation of Women Act. During the hearing, the court questioned whether Netflix and X could invoke immunity under Section 79 of the IT Act, which shields platforms from liability for user-generated content.
The next hearing is scheduled for May 22, and the case has brought attention to growing concerns over the content shared on social media and streaming platforms.
