"No ban on 'Bulldozer Justice': Action can proceed if 7 rules are followed"

New Delhi (The Uttam Hindu): The Supreme Court on Wednesday stayed the hearing of a petition challenging 'Bulldozer Justice'. The Court also made strong remarks regarding the demolition of properties belonging to accused or convicted individuals. It stated that arbitrary actions by the administration would not be tolerated, and warned that officials would be held accountable and required to compensate for any damages if bulldozer actions were carried out without proper justification.

The Supreme Court clarified the circumstances under which bulldozer actions could be deemed valid. Despite the stay, bulldozer demolitions may still proceed in certain situations if they meet specific conditions laid down by the Court.

The Court emphasized that officials must understand that if bulldozer actions violate court orders, they would be personally liable for the damages and required to compensate for the demolished properties out of their own pockets. The Court also expressed concern over the distress caused to women, children, and the elderly, who have been subjected to such demolitions, often late at night. It urged officials to exercise caution and avoid unnecessary harm to vulnerable people.

In its ruling, the Supreme Court issued a set of guidelines for carrying out bulldozer demolitions. These guidelines must be followed by the administration before any such action can be taken:

1. A property cannot be demolished solely because its owner is accused or convicted.

2. The matter must be assessed to determine if it is resolvable through other means.

3. A notice must be issued before any bulldozer action.

4. A time must be set for a personal hearing.

5. The administration must justify why bulldozer action is necessary.

6. The process of demolition must be clearly explained.

7. Strict action will be taken against any official who violates these guidelines.

These measures aim to ensure that bulldozer actions are carried out lawfully and with due consideration for the rights of affected individuals.
