Court Sets New Guidelines for Runaway Couples Seeking Protection
Chandigarh(The Uttam Hindu): In the Punjab and Haryana High Court, over 90 petitions are being filed daily by couples who have fled their homes, seeking protection. In light of this, the High Court has issued 12 new guidelines to streamline the process.
The bench, led by Justice Sandeep Mudgil, stated that these guidelines would save the court approximately four hours every day, time currently spent on hearing such petitions. The court emphasized that it is the responsibility of the police and administration to provide shelter and necessary security to these couples. Immediate police action is required in such cases, as the court should be the last resort, only to be approached when no other options are available.
Justice Mudgil highlighted that constitutional courts are meant to ensure citizens' safety, remaining available to protect individuals when they are in danger. However, he pointed out that a large number of such cases being filed daily is not ideal, as it results in wasted court time. To address this, the court has proposed a new mechanism, based on which the police can take action swiftly.
The bench also recommended that a nodal officer be appointed in every district headquarters to handle such cases. This officer should not be of a rank lower than Assistant Sub-Inspector (ASI). This order applies to Haryana, Punjab, and Chandigarh.
The court explained that by implementing these measures, it will save crucial time, which can be used to address long-pending cases. Justice Mudgil reiterated that Article 21 of the Constitution grants every individual the right to life and personal liberty. Therefore, if a person’s life is at risk due to their decision to marry or love marriage, it becomes the administration’s responsibility to provide them with adequate protection.
